Welcome to Empathiq, a business technology firm specializing in integration and automation solutions. By accessing or utilizing our services, you agree to comply with these Terms and Conditions. Please read them carefully. If you do not agree with any of these terms, you should not use Empathiq’s services.
2. Access to Services
Client Access: Access to Empathiq's platforms and tools is granted exclusively to clients under a valid contract agreement. Once an agreement is in place, clients will receive credentials to access the relevant services and tools.
Usage Rights: Clients are granted non-exclusive, non-transferable rights to use Empathiq’s services as per the terms outlined in their contract. This access is subject to compliance with these Terms and Conditions.
3. Prohibited Uses
You agree not to:
Use Empathiq for any illegal purposes or in ways that could harm us, our partners, or others.
Use Empathiq to develop competing products or services.
Attempt unauthorized access to any part of Empathiq or its connected systems.
Use Empathiq in any way that disrupts, damages, or impairs the service or others’ use of it.
4. Fees and Payment
Subscription Plans: All Empathiq subscription plans require a minimum commitment of 12 months, whether billed annually or monthly. We offer a range of plans designed to meet different business needs, ensuring flexibility and value for our clients.
Custom Plans: For clients requiring tailored solutions, custom plans are available. These may be structured on a payment schedule or, for one-off projects, require a 50% deposit at the time of signing, with the balance due upon final deliverable or as specified in the custom SLA. We strive to provide clarity and support throughout the process to ensure your needs are met.
5. Refunds
Refunds are considered on a case-by-case basis, but due to the customized nature of our technology solutions, refunds are generally subject to denial. We are committed to working with you to address any concerns and ensure satisfaction within the scope of our services.
6. Data Security
We are committed to building on platforms that meet your specific compliance and security needs. However, Empathiq cannot be held responsible for any breaches of data security that occur on client-approved platforms. We will work diligently to ensure the highest standards of security but cannot guarantee absolute protection against breaches.
7. Feature Upgrades and Enhancements
Clients on a current Empathiq plan are eligible for incremental upgrades and enhancements throughout their engagement with us. Foundational new services will be available as formal upgrades either at the time of contract renewal or through client opt-in. We are dedicated to ensuring our clients benefit from the latest innovations and improvements.
8. Termination
We may suspend or terminate your account without prior notice for any violation of these Terms. Upon termination, your access to Empathiq will cease immediately. You may terminate your account by discontinuing use of the service.
9. Limitation of Liability
To the maximum extent permitted by law, Empathiq and its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or goodwill, arising from your use of or inability to use Empathiq.
10. Changes to the Terms
We may update these Terms at our discretion. Significant changes will be communicated to you at least 30 days before they take effect. Continued use of Empathiq after changes signifies your acceptance of the new terms.
11. Governing Law
These Terms are governed by all applicable laws, without regard to its conflict of law principles.
